From the Mayor in accordance with the General Laws of Massachusetts, Chapter 44, recommending that the City Council authorize the acceptance and expenditure of the grant award in the amount of $50,000.00 from the Massachusetts Office of Travel and Tourism to the Police Department. These funds are a part of the FY26 Sport and Entertainment Grant and will be used to support public safety costs for the FIFA watch parties.

  28. From the CFO in accordance with Section 5 of Chapter 324 of the Acts of 1990, certifying that the financial resources and revenues of the City of Brockton are and will continue to be adequate to support the acceptance and expenditure of the grant award in

    the amount of $50,000.00 from the Massachusetts Office of Travel and Tourism to the Police Department, without detrimental impact on the continuous provision of the existing level of municipal services. These funds are a part of the FY26 Sport and Entertainment Grant and will be used to support public safety costs for the FIFA watch parties.

  29. From the Mayor in accordance with the General Laws of Massachusetts, Chapter 44, recommending that the City Council authorize the transfer of the administration of grant funds in the amount of $175,000.00. This order will shift the administration of funds awarded to the City by the Barr Foundation to the office of Planning and Economic Development to fund a transportation manager position within the department.

  30. From the CFO in accordance with Section 5 of Chapter 324 of the Acts of 1990, certifying that the financial resources and revenues of the City of Brockton are and will continue to be adequate to support the total proposed transfer of the administration of grant funds in the amount of $175,000.00, without a detrimental impact on the continuous provision of the existing level of municipal services. This order will shift the administration of funds awarded to the City by the Barr Foundation to the office of Planning and Economic Development to fund a transportation manager position within the department.

    General Court for approval under Clause (1) of Section 8 of Article 2, as amended, of the Amendments to the Constitution of the Commonwealth of Massachusetts, and to the end that legislation be adopted precisely as follows, except for clerical or editorial changes of form only.

    AN ACT RELATIVE TO ELECTION RECOUNT PROCESS AND SIGNATURE REQUIREMENTS OF THE MAYOR, CITY COUNCIL AND SCHOOL COMMITTEE IN THE CITY OF BROCKTON FOR NAME TO BE PLACED ON BALLOT FOR NOMINATION.

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

    SECTION 1 – Any person who is qualified to vote for a candidate for any elective

    municipal office and who is a candidate for nomination thereto, shall be entitled to have his or her name as such candidate printed on the official ballot to be used at a preliminary election; provided, that within the time prescribed by section ten of chapter fifty-three in the case of preliminary elections in cities he to shall file with the city clerk a statement in writing of his candidacy as provided for in the City Charter for the City of Brockton, and with it the petition, he or she must submit the signatures of at least fifty voters qualified to vote for a candidate for the positions of Ward Councilor or School Committee

    Member, and signatures at least one hundred voters qualified to vote for a candidate for the positions of City Councilor at Large and at least one hundred and fifty voters

    qualified to vote for a candidate for the positions of Mayor.

    SECTION 2 – A petition for a recount may be filed with the city clerk on or before five o’clock post meridian on the sixth day following a primary or preliminary election, or on or before five o’clock post meridian on the tenth day following an election, if fifty or

    more voters of shall sign in person as registered, or substantially as registered, and shall state the address where he or she is currently living with the street and number, if any, and his or her address on January the first preceding. If it appears that the difference in

    the number of votes cast for the two leading candidates for the office, or in the number of affirmative and negative votes on a question, for which recount is desired is more than

    one half of one per cent of the total number of votes cast for such office or on such question, the petitions for recount shall be void.

  60. ORDINANCE: AN ORDINANCE RELATIVE TO WHOLESALE RESIDENTIAL KITCHENS

    Be it ordained by the City Council of the City of Brockton to adopt a new ordinance where appropriate as follows:

    Section 1. Definitions

    1. “Cottage Food Operation” means a person who produces cottage food products only in the home kitchen of that person’s primary domestic residence

    2. “Cottage Foods” means non-time/temperature control for safety baked goods, jams, jellies, and other non-time/temperature control for safety foods produced in cottage food operations. Wholesale Residential Kitchens may not prepare finished products that require hot or cold holding for safety, including meat or fish that is raw or heat-treated, certain cut produce including melons, leafy greens, and tomatoes.

    3. “Wholesale Residential Kitchens” is any cottage food operation that sells directly to the consumer that merchandise cannot be sold from the home in person.

      Section 2. Permits

      1. A Wholesale Residential Kitchen permit shall be required for any resident who wishes to prepare cottage foods and other foods deemed to be admissible by Inspectional Services Department (ISD). Residents must apply for the permit through ISD.

      2. The annual fee for a Wholesale Residential Kitchen permit shall be one hundred ($100.00) dollars.

      3. Applicants shall obtain all necessary permits and regulatory approvals that may be required to safely operate a Wholesale Residential Kitchen.

      Section 3. Training and Information

      1. ISD will ensure that residential kitchen permittees and anyone working in the kitchen is certified through a nationally accredited food safety certification exam organization recognized in Massachusetts and meets Massachusetts Food Allergens Awareness Training certification requirements.

      2. ISD shall ensure all Wholesale Residential Kitchen permittees receive training and any other necessary safety information regarding labor laws, fire safety, and other related information as necessary.

      3. The permittee shall sign and return all required certificates, trainings, and informational packets as required by ISD.

      Section 4. Health Code Standards for Permitted Residential Kitchens

      All Wholesale Residential Kitchen Operations shall comply with State Sanitary Code 105 CMR 590. A physical copy of these guidelines shall be given to every permittee.

      Section 5. Compliance and Enforcement.

      1. Inspection. Wholesale Residential Kitchens shall receive annual inspections through the Inspectional Services Department (ISD), and shall comply fully with their rules and regulations. Wholesale Residential Kitchen may also be subject to random compliance inspections.

      2. Requirement to Include Permit Number on Advertisements. The permit number issued by the Department shall be included on all advertisements promoting the Cottage Food Operation.

      3. Signage. No exterior signage shall be allowed.

      4. Penalties. Any person found to be operating a Wholesale Residential Kitchen in violation of this Section or in violation of the terms of their permit may be subject to a fine of up to three hundred ($300.00) dollars per day. The City of Brockton Department of Health and Human Services or their designee may issue a written warning, a notice of violation, a fine, and/or suspension or revocation of permits.

      5. Enforcement. The provisions of this section may be enforced in accordance with the noncriminal disposition process of M.G.L. c. 40, s. 21D, and M.G.L. Chapter 40U as accepted by the City of Brockton.

      6. Notification. ISD may give notice to the landlord, or other appropriate entity, that a Wholesale Residential Kitchen exists at the permittees location.

      Section 6. Regulations.

      The Commissioner of Health and Human Service shall promulgate rules and regulations necessary to implement and enforce the provisions of this Section.

      Section 7. Reporting

      ISD shall prepare an annual report detailing the number of applicants, recipients of Whole Residential Kitchen permits, and other relevant information and submit it to the City Clerk.

  63. ORDERED: The City of Brockton grants to Massachusetts Electric Company an Easement over, across, and under City-owned land identified as 9 Cinder Road, Pembroke, Massachusetts, to provide certain limited access through, over, across or under the identified parcel as more particularly described in the proposed Easement attached to this Order. The City Council authorizes the Mayor to execute the attached Easement and to take other actions as necessary to carry out the terms, purposes, and conditions of the same.

  64. ORDERED: That the Mayor and/or Treasurer/Collector be authorized to execute any and all documents necessary to convey the property consisting of 3,100 square feet, located and known as Plot 7B Country Club Lane, Parcel ID: 079-130 to Cheryl Anderson, 208 Country Club Lane, Brockton, MA 02301 for the purchase price of One Thousand Two Hundred Dollars ($1,200.00). Said property to be sold under the Abutter Lot Program and to be sold with a permanent non-buildable restriction. Said property shall also merge with abutting lot of the purchaser within 6 months of purchase. The 6 months begins at the time the deed is executed.

    If the Grantee fails to merge the premises as stated the City of Brockton reserves the right to revert the premises back to the City ownership at no cost and for no consideration.   65. RESOLVED, to invite Troy Clarkson, Chief Financial Officer of the City of Brockton, to appear before the City Council sitting as the Finance Committee, to discuss the City’s Capital Policy, Capital Improvement Budget Policy, Six Year Capital Plan, all as set forth in the FY27 Budget Book, including without limitation, the process followed to create the Plan, and such other topics related to capital planning for the City of Brockton.
